By using MakeMemorial (“the Service”), you agree to these Terms of Service. Please read them carefully. If you do not agree with these terms, please do not use the Service.

1. The Service

MakeMemorial provides a platform for creating and hosting digital memorial pages. We offer both free and premium tiers to ensure every family has access to a dignified space to honor their loved ones.

2. Account Responsibilities

• •You must provide accurate and complete information when creating an account.
• •You are responsible for maintaining the security of your account credentials.
• •You must be at least 18 years old or have parental consent to use the Service.
• •You are responsible for all activity that occurs under your account.

3. Memorial Content

When creating a memorial, you agree that:

• •You have the right to share the content you upload (photos, text, videos, audio).
• •The memorial is created in good faith to honor a real person.
• •Content must not contain hate speech, harassment, or illegal material.
• •You retain full ownership of all content you upload.

4. Pricing & Payments

• •Basic Plan: Free forever with core features.
• •Premium Monthly: $4.99/month, cancel anytime. No refunds for partial months.
• •Lifetime Legacy: One-time payment of $49.99 for lifetime access to all premium features.

All payments are processed securely through Stripe. Prices are in USD and may be subject to applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers.

You agree not to use MakeMemorial to:

• ✗Create fraudulent or misleading memorials
• ✗Upload illegal, harmful, or offensive content
• ✗Harass, abuse, or threaten other users
• ✗Attempt to hack, disrupt, or exploit the Service
• ✗Use the Service for commercial advertising or spam

7. Termination

We reserve the right to suspend or terminate accounts that violate these terms. If your account is terminated for a violation, you will be notified and given the opportunity to export your memorial data where possible. You may also delete your account at any time by contacting us.

8. Limitation of Liability

MakeMemorial is provided “as is” without warranties of any kind. While we strive to maintain 99.9% uptime and protect your data, we cannot guarantee uninterrupted service. Our total liability is limited to the amount you have paid us in the 12 months prior to any claim.

9. Changes to These Terms

We may update these terms from time to time. When we do, we will notify you via email and update the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated terms.
