Terms of Service

These terms govern use of MakeMemorial. By creating an account or uploading media, you agree to them. If you are using MakeMemorial on behalf of a funeral home, you agree on its behalf.

Using the service

  • You are responsible for the accuracy of the tribute details you enter and for having permission to use the photos and videos you upload.
  • You will not upload content that is unlawful or that infringes someone else’s rights.
  • Family upload links should only be shared with people invited to contribute to a specific memorial.

Content ownership

You and the families you serve retain ownership of the photos, videos, and details you provide. You grant us a limited license to process that content solely to produce and deliver the tribute video.

Music rights

Music in a tribute comes from one of three places, and the rights differ by each:

  • Our stock library. These recordings are cleared for use in tributes you produce with MakeMemorial, including at a service and on a memorial page. They may not be extracted and used separately.
  • Music we generate for you. Cleared on the same basis as the stock library.
  • A song you upload. You are responsible for holding the rights to it. A purchased copy of a song — a CD, a download, or a streaming subscription — is a licence to listen, not a licence to put it in a video. Commercial recordings are the usual reason a tribute is muted or taken down when a service is streamed or posted to a platform, and we cannot clear them on your behalf. If in doubt, use a stock track or ask the rights holder.

We may remove content that appears to infringe someone else’s rights.

Orders & delivery

Video products are rendered after checkout and delivered as a downloadable file and/or hosted link. Physical products (such as video books and memory drives) are produced and shipped separately.

Availability

We work to keep the service reliable but provide it “as is,” without warranties. We are not liable for indirect or incidental damages arising from use of the service, to the extent permitted by law.
